Options, rights of pre-emption and joint ventures

An option agreement allows a developer to invest in the promotion of a property for development, without needing to purchase the land immediately.  

Crucial to negotiation of a satisfactory option agreement are rights of access across the term as well as provisions to extend the term of the option by a short time, if obtaining a decision on a planning application takes longer than is expected. The means of agreeing the value to be paid is also important because - a fixed sum may have been agreed or there may be valuation expertise needed to apportion part of the enhanced value within the purchase price.  

Our lawyers are well used to advising on these issues as well as agreeing satisfactory form of transfer to ensure that necessary rights of access have been granted and reserved between the parties.
